ARUN MONGA, J. (ORAL) Matter was taken up for hearing on 31.01.2023, when none appeared for the parties and Registry was asked to issue notices to their respective counsels. Needful has been done.
Learned counsel for appellant appears and states that he could not establish contact with his client despite various attempts and therefore, pleads lack of instructions.
It appears that by sheer effluxion of time, since appeal has been pending for the past 25 years, appellant has lost interest to pursue the appeal, as he has not chosen to contact his counsel. In the premise, instant appeal is dismissed for nonprosecution with liberty to revive the appeal in case appellant contacts his counsel.
