Through this petition under Section 482 Cr.P.C., prayer has been made for issuance of directions to respondents No. 2 and 3 to submit final report before the concerned Court in case FIR No. 51 dated 13.07.2009 (Annexure P-1) registered under Section 304 read with Section 34 IPC at Police Station Ranger Nangal, Police District Batala. Learned State counsel submits that final report in the shape of cancellation report has been filed thrice in the concerned Court on 12.03.2011, 13.06.2013 and 09.10.2014, but the Court did not accept the same and every time ordered for re-investigation. As per FSL report, no poisonous substance was found in the viscera of deceased-Paramjit Kaur. Her husband-Sahib Singh @ Nishan Singh, who has lodged aforesaid FIR, RISHU KATARIA 2018.08.09 16:21 I attest to the accuracy and integrity of this document

CRM-M-29865-2017 -2has also expired. There was no injury mark on the body of deceasedParamjit Kaur. The doctor from whom the Investigating Officer had sought opinion about the cause of death of Paramjit Kaur, has informed that the cause of death is not ascertainable. After receipt of the FSL report and finding no incriminating evidence against anyone, the police has left with no other option, therefore, the cancellation report for the fourth time would be filed before the concerned Court/Illaqa Magistrate, within 15 days from today.

In view of the above, the instant petition stands disposed of, with a direction to the State to file cancellation/final report whatsoever pertaining to aforesaid FIR (Annexure P-1), positively within 15 days from today to the concerned Court/Illaqa Magistrate.
