Main case Instant petition has been filed under Section 439 Cr.PC seeking grant of interim bail on medical grounds for a period of eight weeks in complaint case with NCB Crime No.11/2023 dated 13.05.2023 under Sections 8, 15, 25, 27-A, 29, 60 and 62 of NDPS Act registered at Police Station NCB Chandigarh.

Learned counsel for NCB while drawing the attention of this Court to the affidavit dated 23.05.2024 filed by the respondent submits that though the petitioner had some medical issues, however, he had been promptly treated for the same and had been admitted in LNJP SONIA BURA 2024.05.29 18:20 I attest to the accuracy and integrity of this document

CRM-M-22194-2024 -2Hospital, Kurukshetra. He further submits that since the condition of the petitioner is stable now, there is every likelihood that he can be discharged within 3-4 days.

Learned counsel for the petitioner has, however, submitted that on one of the earlier occasions, the doctor had advised the petitioner to undergo angioplasty and hence, the petitioner be permitted to undergo angioplasty at PGIMER, Chandigarh at his own expenses. 4.

Learned counsel for the respondent does not oppose the prayer made by the counsel opposite and submits that in case, the petitioner is given any such advice to undergo angioplasty, the jail authorities would not hesitate to get him admitted in the PGIMER, Chandigarh for necessary procedure.

Heard learned counsel for the parties and perused the relevant material on record.

In the circumstances, the present petition is disposed of with directions to the authorities concerned that in case, the petitioner is advised to undergo angioplasty, he be got treated from PGIMER, Chandigarh at his own expenses without any delay.
