IN THE HIGH COURT FOR THE STATES OF PUNJAB AND

HARYANA AT CHANDIGARH CRM-M- 29883 of 2015 (O&M) Date of Order: 29.09.2015 Gurtegh Singh ....Petitioner

Versus

State of Punjab ....Respondent

CORAM:

HON'BLE MR. JUSTICE AJAY TEWARI

Present:

Mr. Vaibhav Narang, Advocate for the petitioner. Mrs. Amarjit Kaur, Addl.A.G, Punjab.

1. Whether Reporters of local papers may be allowed to see the judgment?

2. To be referred to the Reporters or not?

3. Whether the judgment should be reported in the Digest? AJAY TEWARI, J (ORAL) Prayer is for grant of regular bail in case FIR No.135 dated 06.09.2013 under Sections 21/25/29/61 of the NDPS Act, P.S Gharinda, District Amritsar (Rural).

Learned counsel for the petitioner contends that nothing was recovered from the petitioner and he has been in custody for the last about two years.

Learned State counsel states that since it is a case of huge recovery, it may not be appropriate to grant bail to the petitioner. It is pointed out that out of 21, five prosecution witnesses have been examined and the prosecution will lead its entire evidence by 24.12.2015 subject to the accused not obstructing the same.

Without commenting upon the merits of the case, present petition is disposed of with a direction that in case, the prosecution does not conclude its evidence by 24.12.2015 the petitioner shall be released on bail by the learned trial Court to its satisfaction subject to the accused not obstructing the same.
