(Oral) Applicant Sangeeta, who is respondent in the divorce petition filed by her husband Satish Kumar pending before Principal Judge, Family Court, Panipat by way of filing the present petition seeks transfer of that petition to the Court of Principal Judge, Family Court, Rohtak.

According to the applicant, she is residing with her parents at Rohtak and distance between Rohtak and Panipat is about 85 kms. Parents of the applicant are senior citizens and it is difficult for her to travel such distance. Furthermore, two more cases filed by the applicant are pending in Courts at Rohtak. The applicant is unable to contest the divorce petition properly under the circumstances. 3.

Notice of the petition was given to the respondent who was duly served but has not put in appearance.

I have heard learned counsel for the applicant besides going SUMIT KUMAR 2023.07.10 13:22 I attest to the accuracy and authenticity of this order/judgment

through the record.

Keeping in view the contentions in the application and submissions made by learned counsel for the applicant, in which I find merit, in absence of any strong circumstance to the contrary, it would be proper and appropriate, if the application is accepted. The same is accordingly allowed. The petition in question is ordered to be withdrawn from the Court of Principal Judge, Family Court, Panipat and transferred to Family Court at Rohtak for disposal in accordance with law. 6.

The parties are directed to appear in the transferee Court on 04.08.2023. Copies of order be sent to both the Courts for information and necessary compliance.
