As per allegations, petitioner is alleged to have caused a firearm injury on the left biceps of the complainant-Sarwan Singh and chest of the brother (Raj Kashmir Singh) of complainant while the petitioner had walked in on 17.5.2015 at 10.15 pm in the night and inquired about whereabouts of owner-Makhan Singh of the Dhaba.
It is contended that a scuffle had occurred at the spur of moment and the petitioner had also suffered four injuries including grievous injury attracting Section 326 IPC in the cross version case against the complainant party. CRM-M 29909/2015 arrested on 27.5.2015 from the hospital on his discharge and after completion of the investigation,challan has been presented. Both the said injuries attributed to petitioner have been opined to be simple in nature.
Learned State counsel on instructions from HC Balwinder Singh states that challan has since been presented. Without expressing anything on the merits of the case, keeping in view the fact that the challan has been presented and the trial is not likely to be concluded in near future and no useful purpose would be served by keeping the petitioner in custody, the present petition is allowed and petitioner is directed to be released on bail subject to the satisfaction of CJM/Duty Magistrate,Hoshiarpur. 09.09.2015.
