HARINDER SINGH SIDHU, J The petitioner is accused in case FIR No.155 dated 08.06.2002 under Sections 279,337,338 IPC registered at P.S Civil Lines, Karnal. As per allegations, the petitioner while driving his car in rash and negligent manner had caused the accident resulting into injuries to the complainant Satnam Singh son of Resham singh. He was released on bail by the trial Court and was facing the trial.

It is the case of the petitioner that in the year 2007, he was informed by his counsel that in view of compromise effected between the petitioner and the complainant, the petitioner was acquitted of the charges. It is only in the year 2021 that the petitioner learnt that the matter has not been closed and in fact, the petitioner had been declared as proclaimed offender and his bail bonds had been cancelled and warrants have been issued.

Learned counsel for the petitioner submits that the petitioner is an illiterate person. He has no knowledge of either continuation of the proceedings against him or initiation of PO proceedings. CRM-M-19465 of 2021 #2# appearing before the trial Court from the year 2002 to 2006. He undertakes that the petitioner shall appear before the learned trial Court on any date to be fixed by this Court.

Mr. Pankaj Midha, Addl.AG, Haryana, accepts notice on behalf of the respondent-State of Haryana.

Having heard learned counsel for the parties and taking into account the facts of the present case, this petition is disposed of with the observation that the petitioner may appear before the learned trial Court on or before 04.08.2021. On his doing so, he shall be enlarged on bail by the trial Court subject to his furnishing bail bonds and surety bonds to its satisfaction. He shall also file an undertaking before the concerned Court to continue appearing as and when required apart from following all the terms and conditions fixed in this respect.

This shall, however, be subject to the petitioner depositing a sum of Rs.20,000/- with the Poor Patients Welfare Fund of PGIMER, Rohtak.
