Petitioner prays for the grant of anticipatory bail in FIR No.92 dated 20.11.2014, under Sections 498A/406/323 IPC, registered at police station Shahpurkandi, District Pathankot, which has been lodged on the basis of an application submitted by Neelam Kumari i.e., the wife of petitioner. It is submitted that after the police has investigated the matter, allegations have been found to be false against all other family members except the petitioner. Therefore, the complainant loses its credibility. It is further submitted that though the petitioner is not ready to rehabilitate the complainant, OMKAR SINGH 2015.01.30 12:02 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-2994 of 2015 [2] he is ready and willing to settle the matter with the complainant. I have heard learned counsel for the petitioner. There are specific allegations against the petitioner. Medico legal reports of the complainant indicate injuries caused to her on two occasions i.e., 20.07.2012 and 24.11.2012. Furthermore, on perusal of order dated 14.01.2015 it emerges that an opportunity for settling the matter was afforded to the petitioner while granting him interim relief by the learned Sessions Judge, Pathankot. However, mediation proceedings had failed. Keeping in view the entirety of the facts and circumstances of the case, it is not deemed expedient to extend the benefit of anticipatory bail to the petitioner.
Petition is accordingly dismissed.
