State of Punjab .............Respondent CORAM: HON'BLE MR.JUSTICE JASWANT SINGH Present:- Mr.Aditya Sanghi,Advocate for the petitioner Mr.Kirat Singh Sidhu,Deputy Advocate General for State of Punjab Jaswant Singh,J.(Oral) Prayer is for grant of regular bail in case FIR no.32 dated 15.4.2015 under Sections 363,366-A/34 IPC, later on offences under Section 376 IPC and 3,4 and 5 of POCSO Act,2012 added, registered at PS Boha Distt.Mansa,Punjab.

As per allegations petitioner is alleged to have taken the minor prosecutrix aged 161⁄2 years and the main accused Gurpreet Singh in his car to drop them at the fields of said Gurpreet Singh. It is contended that the prosecutrix and co-accused Gurpreet Singh were having love affair and in compliance of their plan to get married the prosecutrix had voluntarily accompanied the petitioner from her home in the car of the petitioner alongwith Gurpreet Singh. CRM-M 29953/2015 the petitioner and he is in custody since 17.5.2015. Learned State counsel on instructions from HC Sukhbir Singh states that challan has been presented and charges have also been framed.

Without expressing anything on the merits of the case, keeping in view the fact that the challan has been presented and the trial is not likely to be concluded in near future and no useful purpose would be served by keeping the petitioner in custody, the present petition is allowed and petitioner is directed to be released on bail subject to the satisfaction of CJM/Duty Magistrate,Mansa. 09.09.2015.
