Through this petition under Section 439 Cr.P.C., the petitioner has prayed for grant of regular bail in case FIR No. 33 dated 08.06.2017 registered under Sections 302 and 201 read with Section 34 IPC at Police Station Kanwan, Pathankot, District Pathankot. 2.

Allegations against the petitioner are that she helped her husband/co-accused in burning his clothes after he committed the murder of Sunny Kapoor @ Sonu (deceased).

Learned counsel for the petitioner contends that the petitioner has been falsely implicated. The marriage between the petitioner and her husband/co-accused, namely; Ajay Kumar, went into rough weather long back and several litigations are pending in between them, therefore, the alleged complicity of the petitioner with her husband/co-accused is patently false.

In view of the totallity of the facts and circumstances, this Court is of the considered opinion that the petitioner at least deserves the concession of regular bail. Thus, without expressing any opinion on the merits of the case and also the fact that the trial is likely to take time, the instant petition is allowed and the petitioner is ordered to be released on regular bail, subject to her furnishing adequate bail bonds/surety bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Pathankot.
