(Oral) Learned counsel for the petitioner submits that in view of the fact that some evidence has already been recorded and the application filed by the State under Section 319 Cr.P.C., has been dismissed by the trial Court, he may be permitted to withdraw the present petition with liberty to file afresh application for regular bail before the trial Court in view of the changed circumstances.
