CORAM:

HON'BLE MS. JUSTICE RITU BAHRI

Present:

Mr. Vipin Mahajan, Advocate, for the petitioner.

Ms. Manpreet Dhaliwal, AAG, Punjab.

**** RITU BAHRI, J. (Oral) Present petition is for release of petitioner on regular bail in FIR No.94 dated 20.07.2016, under Section 354, 354-A and 354-B IPC, registered at Police Station Dhariwal, District Gurdaspur. Learned counsel for the petitioner has argued that only allegation levelled by the complainant against the petitioner in the FIR is that she is working as constable in Punjab Police and on 20.07.2016 when she was going to her house along with her brother Palwinder Singh on motorcycle, the petitioner came from behind and started committing obscene acts with her. Nothing is to be recovered from the petitioner. Learned State counsel has placed on record the custody certificate, today in the Court, which is taken on record. CRM-M-30939-2016 -2I have heard the learned counsel for the parties and with their able assistance gone through the material available on record. As per custody certificate dated 06.09.2016, the petitioner has already undergone a period of 1 month and 14 days. He is facing the criminal trial and no useful purpose would be served to further detain him in jail. The final conclusion of trial will take a long time. In view of above facts, the present petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing adequate bail bonds and surety bonds to the satisfaction of learned trial Judge/Duty Magistrate, Gurdaspur.

Needless to mention that, nothing observed here-in-above, would reflect, on merits in the trial of the main case, in any manner.
