(Oral) Prayer in this petition is for grant of anticipatory bail to the petitioner, in a case arising out of FIR No.452 dated 21.05.2015 (Annexure P-1), registered at Police Station Gurgaon Sadar, who has been booked for having committed the offence punishable under Sections 323, 498, 406 and 506 IPC.
Vide order dated 07.09.2015 passed by this Court, the arrest of the petitioner was stayed, subject to deposit of `50,000/- before the Registrar of this Court. Thereafter, the matter was referred to the Mediation Centre, Gurgaon.
As per the report of the Mediation Centre dated 11.01.2016, the matter has been amicably resolved between the parties. They have agreed to take divorce by mutual consent under Section 13-B of the Hindu Marriage NARESH KUMAR 2016.07.22 16:00 I attest to the accuracy and integrity of this document Chandigarh Act. The petitioner has agreed to pay `5,00,000/- to his wife at the time of
CRM-M-30068-2015 -2first motion and `5,00,000/- at the time of second motion of the mutual consent divorce petition. He has agreed to pay the 50% of educational expenses for his child Veer Khanna. The custody of the minor child will remain with the mother and the father will have the visitation rights. The parties have agreed to solve other case pending with Cyber Crime Cell, Gurgaon.
Keeping in view the fact that the compromise has been effected between the parties, the order dated 07.09.2015 passed by this Court whereby the arrest of the petitioner was stayed is hereby made absolute. The petitioner shall abide by all the conditions as envisaged under Section 438
(2) Cr.P.C.
