***** SUDHIR MITTAL, J. (ORAL) The petitioner seeks regular bail in FIR No.350, dated 13.12.2022, registered at Police Station Civil Lines, District Amritsar, under Sections 181, 419, 420, 466, 468, 471, 474 and 120-B IPC. 2.

Learned counsel for the petitioner submits that the aforementioned FIR was registered on an order passed by a Court because the petitioner had impersonated a Lambardar for furnishing surety of an accused. The petitioner has been in custody now in excess of 05 months. The trial is not likely to be concluded at an early date as charges have still not been framed. Thus, the petitioner may be granted regular bail. 3.

Custody certificate dated 25.05.2023 checked by Sh.Surinder Singh, Jail Superintendent, Central Jail, Amritsar has been filed in Court. The same is taken on record. A perusal thereof shows that the petitioner has undergone actual custody of 05 months and 10 days and one other case of similar nature is pending against him.

Learned State counsel concedes that charges have still not been framed.

Learned counsel for the petitioner submits that in the pending criminal case, the petitioner has been granted regular bail. 6.

Considering the factum of incarceration for 05 months and 10 days and the trial not likely to be concluded at an early date, I deem it appropriate to grant regular bail to the petitioner, however, subject to furnishing bail and surety bonds after taking into consideration the fact that the petitioner has repeated the offence and that a similar allegation has been made against the petitioner earlier also. Accordingly, the petition is allowed. He is ordered to be released on bail on his furnishing bail and surety bonds in accordance with the direction aforementioned to the satisfaction of the trial Court/Duty Magistrate concerned.
