**** SANJAY VASHISTH, J. (Oral) Order dated 11.11.2022, says as under:- "Learned counsel appearing on behalf of the appellant, submits that the filing counsel Sh. J.S. Bedi, has been elevated to the Bench of this Hon'ble High Court, and he has no clear instructions to argue the present appeal, as he is unable to contact the appellant, despite of sending information at his address. Learned counsel for the appellant expresses inability in arguing the matter in the absence of any Vakalatnama of the appellant in his favour.

Adjourned to 12.12.2022, for arguments.

Registry is directed to send notice to the appellant about the next date fixed before this Court for arguments." Office report dated 09.12.2022 available on case file, says as under:- "Submitted for 12/12/22.

Notice issued to the appellant has been received back unserved with the report that applicant has died and also report attached herewith at Flag 'B' for kind perusal."

Along with report, copy of death certificate dated 28.03.2011, JAWALA RAM 2022.12.14 18:15 I attest to the accuracy and authenticity of this order/judgement.

CRA-S-2014-SB-2002 - 2 - issued by the Registrar, Birth & Death, CHC, Bondkalan, Bhiwani, is also attached. As per the said death certificate, appellant - Vijender Singh, expired on 24.03.2011.

In view of aforementioned report, which is on the record of the present case, present appeal stands abated, however, same will be subject to the terms & conditions, passed by this Court in IOIN-CRA-S-4686-SB-2018 in CRA-S-4686-SB-2018, titled as, "Shivji Ram @ Dimple Vs. State of Punjab", decided on 24.11.2022.

Appeal stands disposed of accordingly.
