Counsel for the complainant has made available a copy of the order dated 18.5.2016 in support of the contention that the present petition for pre-arrest bail is not maintainable as the present petition is pre-mature, having been filed after dismissal of an application u/s 438 Cr.P.C. on 18.4.2018 by the Sessions Court. A copy of order dated 18.5.2016 has been handed over to counsel for the petitioner indicating that merits have been considered while dismissing another petition. In view of the said circumstances the petition is not maintainable. The petition is disposed of as such, without prejudice to the right of the petitioner to avail an appropriate remedy by filing a fresh petition u/s 438 Cr.P.C.
Counsel for the petitioner has, however, submitted that the petitioner at present is admitted in DMC, Ludhiana. The said fact may be taken into consideration by the investigating agency in case the petitioner is required to be arrested.
