M.M.S. BEDI, J (ORAL) Petitioner seeks concession of regular bail in a case registered at the instance of Bablu Paswan alleging that he gave lift to co-accused. When complainant stopped his car to attend the call of nature four more co-accused came there and assaulted the complainant. On 15.7.2015, i.e., the next day the car was found abandoned.

The petitioner and his co-accused were arrested in another FIR No.553 dated 7.7.2013 and suffered disclosure statements.

It has been informed that the complainant is not coming forward to depose despite bailable warrants having been issued against him. Co-accused of the petitioner has also been granted the concession of bail.

CRM-M-30215-2014 (O&M) Without expression of any opinion on merits regarding the authenticity of the disclosure statement made to the police, it is sufficient to observe that the petitioner has been in custody w.e.f. 7.8.2013. Six witnesses stand already examined. The trial is not likely to be concluded in near future. The petition is allowed. Petitioner is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of the trial Court.
