Gill, Advocate for the complainant. *** Learned State counsel has submitted that petitioner has been declared a proclaimed offender by Chief Judicial Magistrate, Mansa vide order dated 27.08.2018. A copy of that order has been placed on record. It being so, the present petition cannot survive since in view of settled law by the apex Court in 'Lavesh versus State (NCT of Delhi) 2012(4) R.C.R. (Criminal) 240', 'State of Madhya Pradesh versus Pradeep Sharma 2014(1) R.C.R. (Criminal) 269'. The accused who has been declared an absconder is not entitled to pre arrest bail. Therefore, the petition stands dismissed.
