SANDEEP MOUDGIL, J (Oral) The instant petition has been filed under Article 226 of the Constitution of India for issuance of direction to the respondents to consider and allow the premature release case of the petitioner as he is HIV Positive and has already undergone substantial period of sentence as required for consideration of the case for premature release or in alternative manner, he be shifted in open air prison or semi-open air prison instead of solitary confinement.

Learned counsel for the petitioner prays for withdrawal of the petition with liberty to take recourse to alternative remedial measures in accordance with law.
