REKHA MITTAL J. (Oral) The petitioners pray for grant of regular bail in FIR No.54 dated 03.11.2016 registered at Police Station Kalanaur, District Gurdaspur, for offence punishable under Sections 363, 366-A, 506 and 120-B of the Indian Penal Code (in short 'IPC). Counsel for the petitioners has submitted that challan has been presented in the Court and conclusion of trial is likely to take its own time. It is further submitted that the alleged victim of the crime namely Sharanjit Kaur appeared before the Investigating Officer, got recorded her statement exonerating the main accused - Jaswant Singh of the allegations with regard to kidnapping. Counsel for the State concedes to the position that Sharanjit Kaur, alleged victim recorded her statement and even filed an affidavit dated 13.02.
2017 produced by him and taken on record stating therein that as her father was not agreeable for her marriage with Jaswant Singh, he lodged an FIR against Jaswant Singh and others. In view of the above, without commenting upon merits of Mohd. Yakub 2017.02.
CRM No.M-3020 of 2017 the case, the petition is allowed and the petitioners are ordered to be released on bail on their furnishing bail bonds to the satisfaction of the trial Court. However, they shall remain bound by the following conditions:-
1. They shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer; and
2. They shall not leave India without previous permission of the Court.
