RAMENDRA JAIN, J. (ORAL) Through this petition under Section 439 read with Sections 482 and 437(6) Cr.P.C., prayer has been made for grant of regular bail to petitioner Kamlesh in a case arising from FIR No.771 dated 29.10.2016 registered under Sections 420, 467, 468, 471 and 120-B IPC at Police Station Faridabad, Central, Faridabad.
According to the prosecution, petitioner cheated and defrauded the Government for Rs.77.00 lakhs by withdrawing compensation on the basis of some fake conveyance deed.
Learned counsel for the petitioner inter alia contends that petitioner is a rural, rustic and illiterate woman. She is in custody since 02.05.2017. Conclusion of trial may take a sufficient long time. No useful purpose would be served by keeping the petitioner behind bars. On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.
