Present petition has been filed by the petitioner under Section 528 of BNSS, 2023 for quashing of impugned order dated 17.12.2025 (Annexure P-2) passed by learned Judicial Magistrate Ist Class, Batala, District Gurdaspur in case bearing No.COMI-63-2022 dated 02.04.2022, vide which application for recording of evidence of Baldev Singh through video conferencing has been dismissed.

After arguing for some time, learned counsel for the petitioner limited his prayer to the extent that period of one month be given to the said witness to appear before the trial Court for his deposition in physical form. 3.

Keeping in view the nature of prayer, there is no need to issue any notice to the respondents.
