******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in criminal complaint No. 337 of 2016 dated 05.04.2016 titled as "Kulwinder Singh Vs Vijay Kumar" pending in the Court of Judicial Magistrate Ist Class, Ferozepur, wherein he has been summoned to face trial for the offence punishable under Section 138, 142 of Negotiable Instrument Act (for short NI Act).
Heard.
Learned counsel for the petitioner submits that the petitioner has surrendered before the trial Court and has been allowed interim bail in terms of order dated 21.08.2017.

CRM-M-30214-2017 -2Learned counsel for the complainant endorses the submission of learned counsel for the petitioner to this fact. The petitioner was summoned in a complaint filed by respondent No. 2 for the offences punishable under Sections 138, 142 of NI Act.
Keeping in view the fact that the petitioner has surrendered before the trial Court as per order dated 21.08.2017, this petition is allowed and the order dated 21.08.2017 is made absolute subject to the condition that petitioner shall apply for regular bail (if not applied and allowed so far) before the trial Court and will keep on appearing on each and every date of hearing. In the event of his non-appearance on any date without permission, the trial Court will be competent to cancel his bail and forfeit the bail bond and surety bond and proceed against him in accordance with law.
