CORAM : HON'BLE MR. JUSTICE N.S.SHEKHAWAT
Present:
None for the petitioner.
Mr. Deepinder Brar, Sr. DAG, Punjab.
Mr. Krishan Garg, Advocate for the complainant.
N.S.SHEKHAWAT, J. (Oral) 1.
The petitioner has filed the present petition under Section 482 of the Code of Criminal Procedure with a prayer to quash the FIR No.62 dated 08.07.2015 under Sections 420, 465, 467, 468, 471 and 120-B at Police Station Kabarwala, District Muktsar Sahib (Annexure P-2) with all the consequential proceedings arising therefrom. 2.
Learned State counsel on instructions from ASI Bohar Singh submits that in the present case 11 witnesses out of total 21 witnesses have been examined so far and the trial is at an advanced stage. 3.
Since the trial in the present case has already progressed and 11 witnesses have been examined, it would not be appropriate to quash the FIR at this stage. Conseqently, the present petition is ordered to be dismissed. 4.
Needless to observe that the petitioner is at liberty to raise all the pleas, before the learned trial Court at an appropriate stage. 5.
Disposed off.
