Petitioner seeks the concession of pre-arrest bail in a case registered at the instance of Kuldeep Singh and Gamdoor Singh alleging that by playing fraud upon the complainants, the petitioner along with Chamkaur Singh had been instrumental in getting the bank limits of Rs.15 lacs in the name of the complainants and transferring the proceeds into their account. The petitioner is a Commission Agent and complainants appear to be farmers. I have considered the facts and circumstances of the case. Illiterate complainants have been duped. The petitioner is a Commission Agent. During the course of investigation, the records of the bank have been collected which indicate the grant of limit of Rs.15 lacs each to the complainants. The amount of limit in the

CRM-M-3111-2016 (O&M) account of petitioner could not be justified by the counsel for the petitioner. However, Counsel for the petitioner has argued that the amount has been repaid to the complainants on different occasions for agricultural purposes; for marriages in the family; for constructions of respective houses and for sending their children abroad. In view of the documentary evidence available against the petitioners, the contention of counsel for the petitioner regarding transactions in favour of the complainants by the petitioner cannot be believed at this stage.

No ground is made out for the grant of pre-arrest bail to the petitioner. The petition is dismissed without prejudice to the right of the petitioner to approach this Court again in case the matter regarding money is settled between the parties. (M.M.S. BEDI) January 29, 2016.
