RAMENDRA JAIN, J. (ORAL) Case has been taken up for hearing through video conferencing due to Covid-19 pandemic.

Custody certificate sent through e-mail is taken on record. Through instant petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner - Jaspreet Singh @ Channa - in case arising from FIR No.188 dated 08.11.2018 registered under Sections 302, 307, 148 and 149 IPC (Section 323 IPC added later on) and Section 25 of the Arms Act, 1959 at Police Station Dinanagar, District Gurdaspur.

Learned counsel inter alia contends that petitioner was not named in the FIR. He was booked in this case on the statement of Gurpreet Singh @ Kaka. Co-accused of the petitioner, namely, Ankush Mahajan @ Thana, Davinder Singh @ Binda, Sajan Kumar @ Sajan, Ankush Kumar RAVINDER SINGH 2020.07.10 15:09 I attest to the accuracy and integrity of this document

-2CRM-M-16262 of 2020 and Bunti @ Sarabjit have been granted regular bail by this Court vide orders dated 16.05.2019, 27.06.2019, 10.09.2019, 15.10.2019 and 18.12.2019 passed in CRM-M-21690 of 2019, CRM-M-27205 of 2019, CRM-M-31809 of 2019, CRM-M-42725 of 2019 and CRM-M-49679 of 2019, respectively. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioner in jail any more. Thus, treating the case of the petitioner on the same parity as that of his aforesaid co-accused, he may also be granted regular bail. On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, treating the case of the petitioner on the same parity as that of his aforesaid co-accused, petition is allowed. Petitioner - Jaspreet Singh @ Channa - is ordered to be released on bail during pendency of trial, if not required in any other case, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
