**** RITU BAHRI , J. (Oral) Through the instant civil writ petition, preferred under Articles 226/227 of the Constitution of India, petitioners have sought the issuance of a writ in the nature of Mandamus directing the respondents to grant one additional increment of higher responsibility under Rule 4.4(2) (c) (i) as per Vol-1, Part-1 of Punjab Civil Services Rules and in lieu of judgment rendered in CWP No.3922 of 2011 vide order dated 03.10.2016 as well as letter dated 15.03.2018 issued by Finance Department, Haryana on getting promotion on the post of SDE from the date of promotion and re-fix their pay and revised their pension with further direction to the respondents to release the arrears of difference between due and drawn to them along with interest @ 18% per annum.
At the very outset learned counsel submits that some colleagues of the petitioners approached this Court by way of filing CWP No. 18433-2018 with the similar prayer and this Court disposed of the writ petition on 27.07.2018 and in compliance of order dated 27.07.2018, the respondents passed order dated 26.12.2018 granting relief to the petitioners of that writ petition. In this regard, petitioners have served legal notice dated 16.01.2019 Gaurav Arora 2019.04.
CWP No. 9480-2019 (P-4) but no action has been taken till date. Issue notice of motion.
On asking of the Court, Mr. Kiran Pal Singh, AAG, Haryana accepts notice on behalf of the State. Learned counsel for the petitioner shall supply copy of the petition to learned State counsel by today itself. Without expressing any opinion on the merits of the case, this petition is being disposed of by giving direction to respondent No. 3 to look into the legal notice dated 16.01.2019 (P-4) of the petitioners and pass appropriate orders, in view of Annexure P-5 colly.
