Through this petition under Section 439 Cr.P.C., petitionerMurti Devi, has prayed for grant of regular bail in case FIR No. 0183 dated 13.10.2017 registered under Section 306 IPC at Police Station Samana, District Patiala.

According to the prosecution, one Balkar Singh, committed suicide leaving behind a suicide note, naming his wife Sarabjit Kaur, RISHU KATARIA 2018.09.07 19:03 I attest to the accuracy and integrity of this document

CRM-M-31201-2018 -2brother-in-law Shingara Singh, mother-in-law petitioner-Murti Devi and one Harbans Singh, responsible for his death, because his wife had illicit relations with said Harbans Singh.

Learned counsel inter alia contends that petitioner has nothing to do with the alleged illicit relations of wife of deceased with her paramour Harbans Singh. The petitioner, being mother-in-law of the deceased, is innocent and has no role to play in the death of her son-inlaw. She in custody since 14.11.2017. Conclusion of trial may take long time. No useful purpose would be served by detaining the petitioner in jail.

On the other hand, learned State counsel vehemently opposed the above submission of learned counsel for the petitioner. 5.

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner-Murti Devi is ordered to be released on bail pending trial, on her furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
