Prayer in this writ petition filed under Article 226 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondent No.4 to entertain and decide, in a time bound manner, the statutory appeal dated 22.09.2025 (Annexure P8) filed by the petitioner against order endorsement No.451-55 dated 09.09.2025 (Annexure P-7) passed by respondent No.3. Further a writ of certiorari has been sought, for quashing the order endorsement No.451-55 dated 09.09.2025 (Annexure P-7) passed by respondent No.3. Another prayer has been made to direct the respondents to allow the petitioner to rejoin his services in terms of the order endorsement No.129-1413 dated 09.09.2025 (Annexure P-6) passed by respondent No.3 whereby the petitioner was permitted to rejoin his duty. Learned State counsel, on instructions from Mr. Pratap, Senior Assistant, Department of Cooperation, submits that the statutory appeal dated 22.09.2025 (Annexure P-8) filed by the petitioner is pending before respondent No.4 and the same would be decided within a period of four weeks from today, after affording an opportunity of hearing to the petitioner.

Learned counsel for the petitioner confines his prayer to the extent that a direction be issued to respondent No.4 to decide the statutory appeal dated 22.09.2025 (Annexure P-8) within a stipulated period, in accordance with law.

In view of the limited prayer made by learned counsel for the petitioner, without commenting upon merits of the case, the present petition is disposed of and respondent No.4 is directed to hear and decide the statutory appeal dated 22.09.2025 (Annexure P-8) in a time bound manner and pass a speaking order, within a period of four weeks from the date of receipt of certified copy of this order. 5.
Needless to say, if the petitioner is found entitled to the relief sought, if any, the same be granted to him forthwith by respondent No.4.
