Learned counsel for the appellant states that he does not have fresh instructions in the matter, however, it was brought to his notice that the parties have since compromised the matter. Be that as it may, since none has put in appearance on behalf of the appellant and the counsel states that he has no instructions, the present appeal is dismissed for nonprosecution with liberty to revive in case anything survives in the matter.
