This is a petition filed under Section 438 of the Code of Criminal Procedure seeking pre-arrest bail in a case registered against the petitioner vide FIR No. 872 dated 21.07.2015 under Sections 148/149/323/324/506 IPC at Police Station Chandnibagh, district Panipat.

During the pendency of this petition, offence under section 326 IPC has already been added in the FIR. Learned counsel for the State (on instructions from ASI Jasmeer Singh, who is present in court) submits that pursuant to order dated September 08, 2015, petitioner has joined the investigation and is no longer required for custodial interrogation as injury attracting offence under section 326 IPC is attributed to coaccused Shishpal. In view of the above, order dated September 08, 2015 is made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C.
