*** ANUPINDER SINGH GREWAL , J.(Oral) The petitioners have challenged the e-auction notice dated 13.02.2025 (Annexure P-6) whereby the mortgaged property is to be auctioned on 19.03.2025.

Learned counsel for the petitioners contends that petitioners have preferred a Securitization Application No.73 of 2025 before the DRT-III, but the Presiding Officer of DRT-III is unavailable as he is attending a Training Programme.

Issue notice to the respondents.

Mr. Himanshu Sharma, Advocate appears and accepts notice on behalf of respondent-Bank and on instructions from Mr. Ramesh Kumar, Authorized Officer, submits that the auction which was to be conducted today VANITA 2025.03.19 15:38 I attest to the accuracy and authenticity of this order and judgment

CWP-7682-2025 has been deferred.

In view of the statement made by learned counsel for the respondent-Bank, learned counsel for the petitioners wants to withdraw this petition at this stage with liberty to pursue Securitization Application, which is pending adjudication before the DRT-III.

The petition stands dismissed as withdrawn with the aforesaid liberty.
