JASWANT SINGH, J (ORAL) Prayer is for grant of regular bail in case FIR No.42 dated 18.5.2015 under Sections 399,402 IPC and Section 25 of the Arms Act, P.S GRPS Sonepat, District Sonepat.

As per the allegations, on secret information five persons including the petitioner were apprehended armed with danda, knives and iron rods preparing to commit dacoity in a Train on 18.5.2015 around 3.30 AM in the morning.

Learned counsel for the petitioner submits that a false case has been foisted upon the petitioner. Even otherwise, as per the allegations, the petitioner was armed with a iron rod and is in custody since 18.5.2015. Learned State counsel, on instructions from ASI Suresh Kumar, states that the investigations are over and challan has been presented. Without commenting upon merits of the case and keeping in

CRM-M- 30306 of 2015 #2# view the fact that trial shall take long time to conclude and that no other case is pending against the petitioner, no useful purpose would be served by keeping the petitioner in custody any further. Therefore, the petitioner is granted the concession of regular bail and as such is ordered to be released on bail to the satisfaction of CJM/Duty Magistrate, Sonepat. Disposed of.
