(ORAL) Through instant petition under Section 438 Cr.P.C. prayer has been made for grant of anticipatory bail to petitioner Arjun Singh in case FIR No.143 dated 06.06.2018 registered under Section 174-A IPC at Police Station Israna, District Panipat (Haryana).
Heard.
Without commenting on the merits of the case, present petition is disposed of with direction to the petitioner to appear before the Illaqa Magistrate/Duty Magistrate concerned within a week positively. In case petitioner appears and files bail application, the same shall be decided by the Illaqa Magistrate/Duty Magistrate within two days in accordance with law on merits after hearing contentions of the petitioner and dealing with the same. In case, contention of the petitioner is found false, in that eventuality the learned Magistrate may pass any order in accordance with law.
Till decision of the bail application of the petitioner, he shall not be taken into custody.
