Prayer made in the present petition is for directing the respondents to release to the petitioner the arrears of pay for the period from 01.01.1999, the date of his promotion to the post of Deputy Secretary till 31.08.1999. 2.

Learned State counsel refers to para 1 of the preliminary submission of the reply dated 31.10.2002 filed by Deputy Secretary, Secretariat Administration, wherein it has been stated that the petitioner though was given deemed promotion w.e.f. 01.04.1999 in the cadre of Deputy Secretaries vide order dated 22.05.2001, however, as incorporated in the said order, no arrears were to be paid in view of the Finance Department letter dated 08.12.1998 that was issued in compliance to the decision of Hon'ble the Supreme Court in Palaruram Krishnaian and Others vs.
