NARESH KUMAR SANGHI, J.(Oral) Prayer in this petition, filed under Section 438, Cr.P.C., is for grant of anticipatory bail to the petitioners, Geeta Verma and Vinay Kumar, who have been booked for having committed the offence punishable under Section 380, IPC, in a case arising out of FIR No.603, dated 15.05.2015, registered at Police Station,

-2City, Gurgaon.

Learned counsel for the respondent No.2/ informant/complainant at the very outset submits that all the disputes with regard to the property of the temple in question have been resolved and a decree has been passed in favour of respondent no.2/informant/ complainant side. Respondent No.2/ informant/complainant has no objection if the present petition is allowed and anticipatory bail is granted to the petitioners. Though learned counsel for the State, on instructions from ASI Sanjiv Kumar, submits that there is no information with the Investigating Agency that the matter has been compromised but in view of the statement made at bar by the learned counsel for respondent No.2/informant/complainant, he has no objection if the anticipatory bail is granted to the petitioners and they are directed to join the investigation as and when required by the Investigating Agency.

After hearing the learned counsel for the parties and keeping in view the totality of the facts and circumstances of the case, the present petition is accepted. It is directed that the petitioners be released on bail in the event of their arrest subject to their furnishing bail bonds to the satisfaction of the Arresting

-3Officer. The petitioners shall join the investigation as and when required to do so and abide by all the conditions laid down under Section 438(2), Cr.P.C.
