RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner Kewal Singh in a case arising from FIR No.42 dated 05.06.2017 under Sections 365, 342, 506, 148, 149 IPC and Sections 25/27/54/59 of the Arms Act (Section 364A IPC added lateron) registered at Police Station Sadar Rampura, District Bathinda. Learned counsel for the petitioner contends that the petitioner is not named in the FIR nor any role has been attributed to him. He has been falsely implicated and no recovery has to be effected from him. The petitioner is in custody since 08.06.2017.

On the other hand, learned State counsel vehemently opposed this petition submitting that the car in which the complainant was kidnapped and taken away belongs to son-in-law of the petitioner. Recovery of one licensed revolver was also effected from the petitioner. In view of the totality of the facts and circumstances, however, Ravinder Singh 2017.08.24 15:45 I attest to the accuracy and authenticity of this document without commenting on the merits of the case, petition is allowed.

-2CRM-M-30351 of 2017 Petitioner is ordered to be released on bail, on his furnishing bail bonds/surety bonds, to the satisfaction of Trial Court/Duty Magistrate concerned.
