The petitioners have filed the instant petition under Section 482 of Cr.P.C. for quashing of order dated 26.11.2019 (Annexure P-4) passed by learned ACJM, Palwal whereby the cancellation report submitted by the police of Police Station Sadar Palwal in FIR No. 0481 dated 13.06.2017 (Annexure P-1) registered under Sections 379, 420 IPC, 1860 registered at Police Station Sadar Palwal, has been accepted without considering the application of the petitioners.

The case had been filed against the purported initiation of the proceedings by the Illaqa Magistrate in the cancellation report, that had been so filed, without affording an opportunity of hearing to the petitioners. CRM-M- 38008 of 2021 of an affidavit of Rajesh Duggal, IPS, Superintendent of Police, District Palwal had been filed wherein they have averred that earlier it was stated erroneously that the cancellation report had been prepared whereas infact an untraced report had been submitted by the respondents before the Illaqa Magistrate and notice had already been issued to the petitioners.

In view of the above, learned counsel for the petitioners prays for withdrawal of the present petition at this stage so as to take recourse to the alternative remedies in accordance with law. 4.
