  **** HARNARESH SINGH GILL, J.(Oral) Through this third petition, the petitioner seeks regular bail in case bearing FIR No.46 dated 22.04.2021, registered under Sections 379, 413 and Sections 411 and 473 IPC (added later on), at Police Station Bajakhana, District Faridkot, first one being dismissed as withdrawn on 07.12.2021 and second being dismissed on merits vide order dated 03.02.2022 passed by this Court.

Learned counsel for the petitioner submits that the petitioner has falsely been involved in the present case; that though the FIR was registered on the basis of a secret information, yet there is no writing qua the same; that the petitioner has been in custody since 22.09.2021 and that the allegation against the petitioner is that he along with the coaccused used to travel in night, steal valuable copper and oil from the transformers installed in the fields and sell the same in junk. He further submits that as co-accused, namely, Jagseer Singh, Karamjit Singh @ Motu, Surjit Singh @ Dilli and Nachattar Singh, have already been AMAN JAIN 2022.08.05 17:52 I attest to the accuracy and authenticity of this order/judgment

CRM-M-17936-2022 (O&M) -2granted the concession of regular bail by a Coordinate Bench of this Court, the petitioner may also be granted such concession. On the other hand, while opposing the prayer for grant of regular bail to the petitioner, learned State counsel submits that the petitioner had actively participated in the alleged crime and that the petitioner is a habitual offender, inasmuch as, there are five more cases registered and/or pending against him. Out of the said cases, the petitioner stands convicted in one, acquitted in one and the remaining three are under trial. He further submits that the earlier bail petitions preferred by the petitioner was dismissed as withdrawn and dismissed on merits vide orders dated 07.12.2021 and 03.02.2022 and that there is no change in the circumstances.

I have heard the learned counsel for the parties. As noticed above, pendency of five more cases against the petitioner speaks volumes about his brazen antecedents. Thus, the possibility of the petitioner indulging himself in similar crime(s) if enlarged on bail, cannot be ruled out. Further, the allegation against the petitioner are specific and serious in nature. Above all, the earlier bail petition preferred by the petitioner was dismissed by this Court on 03.02.2022.

Thus, no ground is made out to grant the concession of regular bail to the petitioner.

Dismissed.
