(Oral) The allegations against petitioner Gurpreet Singh in this regular bail application under section 439 Cr.P.C. are that he has facilitated the marriage between the prosecutrix aged around 20 years and co-accused Jaswinder Singh alias Jassi and also a silent facilitator for commission of alleged rape.

The contention of counsel for the petitioner Mr. AS Khinda is that the prosecutrix has married the principle accused Jaswinder Singh @ Jassi and has relied on her affidavit to hammer home the point that the couple has fully married.

Without going into the merits of the case, in view of this situation, it would be traversity of justice, if the petitioner is left to languish DALBIR SINGH TIWANA 2015.09.29 17:06 I attest to the accuracy and authenticity of this document.

Criminal Misc. No. M-30380 of 2015 -2in jail and the fact that trial is not likely to conclude in the near future, this Court is of the opinion that further detention of the petitioner in the present case is not warranted. Accordingly, he is ordered to be released on regular bail to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate, Kapurthala.
