Mr. B.S.Jatana, Advocate for the petitioner Mr. J.S. Brar, AAG, Punjab Fateh Deep Singh, J. (Oral) It is contended that the petitioner is alleged to have been found in illegal possession of 30 kgs of poppy husk on 8.6.2015 when he was apprehended by the police of Police Station Julkan, District Patiala. It is argued that the petitioner is in custody since more than three months and the trial is not likely to be concluded in near future which fact could not be controverted by the learned State counsel who though has vehemently opposed the bail on the grounds that another quantity of 40 kgs of poppy husk has been recovered from another car of his accomplish.
Keeping in view the totality of the circumstances and that the fact that the petitioner has already undergone sufficient incarceration, this Court is of the opinion that further detention of the petitioner in the present case is not warranted. Accordingly, he is ordered to be released on regular bail to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate, Patiala.
