Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.3 dated 05.01.2017 under Sections 177, 188, 448, 109, 120-B IPC, Sections 42, 54 of Prisons Act and Sections 13(i)(d) and 8 of Prevention of Corruption Act, registered at Police Station City Fazilka, District Fazilka.
Notice of motion was issued. Learned State counsel appeared and contested the petition.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. In the present case, earlier, the petitioner was on regular bail and he absented from the Court proceedings. CRM No.M-15471 of 2019 -2dated 12.04.2019, the petitioner has surrendered before the trial Court. The trial of the case will take long time. No useful purpose will be served by sending and keeping the petitioner in custody till the disposal of the case.
Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where the petitioner is entitled to benefit of anticipatory bail. Therefore, the present petition is accepted and the order dated 12.04.2019 granting interim bail to the petitioner, is made absolute, subject to the condition that petitioner will deposit `15,000/- with the District Legal Services Authority, Fazilka, within 15 days and if he fails to do so, then this petition shall be treated as dismissed.
