***** Rajan Gupta, J. (Oral) This petition has been filed under Section 439 Cr.P.C. seeking regular bail to the petitioner in a case FIR No.137 dated 29.10.2016 under Sections 21/22/29/61/85 of NDPS Act, registered at Police Station Chamkaur Sahib, Distric Rupnagar.

Petitioner is incarcerated since 21.11.2017. It is alleged that 40 Grams of intoxicating powder was recovered from her, which is admittedly non-commercial quantity. Besides, an infant is also detained alongwith the petitioner.

Keeping in view the fact that trial may take long time to conclude, period of her incarceration, no useful purpose would be served by detaining the petitioner. Accordingly, petition is allowed and the petitioner is ordered to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Ropar.
