Through this petition under Section 439 Cr.P.C., petitionerSukhdev, has prayed for grant of regular bail in case FIR No.70 dated 18.04.2017 registered under Sections 323, 341, 506, 148, 149, 379-B IPC at Police Station Uchana, District Jind (Annexure P-1). 2.

According to the prosecution, on 17.04.2017 co-accused Sandeep and his associates including the petitioner caused injury to the complainant with lathis and also damaged their vehicle 3.

Learned counsel for the petitioner inter alia contends that the co-accused of the petitioner has been enlarged on the regular bail by the trial Court vide order dated 21.07.2017. He further submits that the petitioner is in custody since 04.05.2017 and the conclusion of the trial would take long time and no useful purpose would be served by keeping the petitioner in custody.

On the other hand, learned State counsel on instructions from ASI Ram Mehar vehemently opposed the bail to the petitioner submitting that though three more cases were registered against the petitioner, but has Sonia Bura 2017.11.07 15:30 I attest to the accuracy and integrity of this document chandigarh

Considering the overall facts and circumstances of the case, but without expressing any opinion on the merits and also that conclusion of the trial may take time, the instant petition is allowed. Petitioner-Sukhdev, is ordered to be released on regular bail pending trial, subject to his furnishing heavy bail bonds and surety bonds to the satisfaction of trial Court, Jind.
