RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner Amritpal Singh in a case arising from FIR No.44 dated 28.03.2016 under Sections 308/34 IPC registered at Police Station Sadar, Phagwara, District Kapurthala. On 27.07.2017, it was wrongly directed to produce co-accused Suman presuming her as wife of the petitioner. In fact, she is the wife of co-accused Gurjinder Singh. According to the learned State counsel, coaccused Suman has already been arrested on 5.8.2017. Accordingly, the order dated 27.07.2017 stands corrected to the extent above. Learned counsel contends that the petitioner is in custody for more than 11⁄2 year. The trial has become de novo after summoning of Suman under Section 319 Cr.P.C. and its conclusion shall take a long time. No useful purpose would be served by detaining the petitioner in jail. On the other hand, learned State counsel vehemently opposed Ravinder Singh 2017.10.13 17:13 I attest to the accuracy and authenticity of this document prayer for grant of regular bail.

Consequently, petitioner is ordered to be released on bail, on his furnishing bail bonds and surety bonds, to the satisfaction of Trial Court/Duty Magistrate concerned.
