Naresh Kumar Sanghi, J.(Oral) Prayer in this petition, filed under Section 438, Cr.P.C., is for grant of anticipatory bail to the petitioners, Malkeet Singh and Jaspreet Singh, who have been booked for having committed the offences punishable under Sections 323, 324, 326 and 506 read with Section 34, IPC, in a case arising out of FIR No.85, dated 22.06.2015, registered at Police Station, Dirba, District Sangrur.

Learned counsel contends that petitioner No.1, Malkeet Singh, has been attributed simple injuries on the nonvital parts of Harnaib Singh; the dispute was with regard to water course; the main injury attracting the mischief of Section 326, IPC, has been attributed to petitioner No.2, Jaspreet Singh @ Jassi.

I have heard learned counsel for the petitioner and with his able assistance gone through the material available on SEEMA RANI 2015.09.10 15:01 I attest the accuracy and authencity of the document

There is no doubt that Kala Singh and Lakhwinder Singh, the co-accused of the petitioners, have already been granted ad-interim anticipatory bail by this Court vide orders dated 03.09.2015 and 08.09.2015 respectively but the role assigned to the petitioners is altogether different. Kala Singh and Lakhwinder Singh were not attributed any injury to the injured persons. Petitioner No.2, Jaspreet Singh @ Jassi, had caused grievous injuries by means of Kirpan attracting the mischief of Section 326, IPC, while petitioner No.1, Malkeet Singh, had caused as many as four injuries by means of a stick on the person of Harnaib Singh.

No ground for grant of anticipatory bail to the petitioners is made out.

Dismissed.
