Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.27 dated 03.05.2016 under Sections 323, 324, 326, 148 and 149 IPC, registered at Police Station Noormehal, District Jalandhar Rural.
I have heard learned counsel for the petitioner and have gone through the record.
From the record, I find that the FIR in the present case has been registered at the instance of Brij Chetan. The present petitioner is named in the FIR. He is the main accused. He was armed with datar and gave grievous injury. The present petitioner is required for custodial interrogation. The weapon is yet to be recovered. Keeping in view the facts and circumstances of the present case Vineet Gulati 2016.09.09 10:39 I attest to the accuracy and authenticity of this document Chandigarh and in view of the fact that the petitioner is the main accused and caused
CRM No.M-31359 of 2016 -2grievous injury, I do not find it a fit case where petitioner is entitled to benefit of anticipatory bail.
Therefore, finding no merit in the present petition, the same is dismissed.
