(Oral) The petitioner has filed the present petition under Section 439 Cr.P.C. seeking regular bail in FIR No.766 dated 24.12.2015 under Sections 201, 203, 212, 213, 214, 217, 218, 342 and 385 ( Sections 166, 180, 420, 120-B were added lateron) and Sections 15/17/18, 27A and 29 of the NDPS Act and Section 13 of the P.C. Act registered at Police Station Samalkha, District Panipat.

Heard learned counsel for the rival parties.

The petitioner who is police officer was arrested on 08.01.2016 in the instant FIR.

Admittedly, the challan has been filed before the competent Court. Upon hearing learned counsel for the rival parties and upon perusal of the documents on record, prima facie I find that there is no point in continuing the detention of the petitioner in jail. The petitioner is under suspension and there is no likelihood of tampering with the prosecution evidence since the witnesses are official. The trial will take its own time. CRM-M-31367-2016 [2] In view of the above, I make the following order: (i) The petition is allowed.

(ii) The petitioner be released on bail to the satisfaction of the Trial Court/Duty Magistrate, Panipat.

(iii) The petitioner shall not tamper or influence the prosecution witnesses.

(iv) In case of violation of the above condition the liberty is reserved to apply for cancellation of bail.
