Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.91 dated 14.06.2016 under Sections 307, 326, 325, 324, 323, 148, 149, 447, 511, 506 IPC and Section 25 of the Arms Act, registered at Police Station Sadar Sangrur. I have heard learned counsel for the petitioner and have gone through the record.
From the record, I find that the FIR in the present case has been got registered by Randhir Singh @ Dhir. The present petitioner is named in the FIR. He was stated to be armed with baseball bat and injury is also attributed to him.
Keeping in view the facts and circumstances of the present case and in view of the fact that the petitioner was armed with deadly weapon and he has taken active participation in the commission of the offence and Vineet Gulati 2016.09.09 10:10 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-31369 of 2016 -2also in view of the fact that the baseball bat is yet to be recovered, I do not find it a fit case where petitioner is entitled to benefit of anticipatory bail. Therefore, finding no merit in the present petition, the same is dismissed.
