Parents of deceased-Ishan have filed the present appeal for enhancement. The Tribunal, vide award dated 29.01.2019, had awarded an amount of 16,16,982/- along with interest as compensation to the ₹ appellants.

It has been brought to the notice of this Court that in the present case, settlement has been arrived at before the Mediation and Conciliation Centre of this Court and the detailed settlement agreement dated 01.10.2025 has been placed on the record. It has been jointly submitted by learned counsel for the appellants and counsel for respondent No.3Insurance Company that as per the said settlement, the Insurance Company is required to pay an additional compensation of ₹65,000/- over and above the compensation awarded by the Tribunal and the same is to be paid within a period of 45 days from the date of order passed by this Court in the name of appellant No.1 as full and final settlement. FAO No.2941 of 2019 influence and the present appeal be disposed of in terms of the said agreement.

Keeping in view the abovesaid facts and circumstances and the joint prayer made by the counsel for the appellant and counsel for respondent No.3, the present appeal is disposed of and the award dated 29.01.2019 is modified in terms of the settlement agreement dated 01.10.2025. Both the parties would be bound by the terms of the said agreement and respondent No.3 is directed to pay an amount of ₹65,000/- as additional compensation within a period of 45 days from today by issuing a cheque/demand draft in the name of appellant No.1 as full and final settlement.
